These Terms of Use and End-User License Agreement (the “Terms”) govern your use of the website getmost.us, the MOST client mobile application, and related online services (together, the “Services”) provided by GETMOST Inc. (“MOST,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
MOST provides company formation, registration, accounting and related business services. The Services let our clients follow the progress of their cases, exchange documents with us, and view invoices and payments related to our services. The Services are an information and communication tool; the professional services themselves are governed by the separate agreement or engagement terms between you and MOST.
You must be at least 18 years old and able to enter into a binding contract to use the Services. Access to the client application is available only to MOST clients. You sign in with a one-time code sent to the phone number or email address you gave us. You are responsible for keeping access to that phone number and email account secure and for all activity under your account. Tell us promptly at hello@getmost.us if you suspect unauthorized access.
Subject to these Terms, MOST grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the MOST client application on devices you own or control, and to use the Services, solely to receive and manage MOST’s services for yourself or the business you represent. All rights not expressly granted are reserved by MOST.
You agree not to:
You keep all rights to the documents and information you upload. You grant MOST a license to store, process, and use them only as needed to provide our services to you. You confirm that the documents you upload are accurate and that you have the right to share them. Documents may be stored with our service providers, such as Google Drive.
The Services work with third-party services, including Kommo (CRM), Google Drive (document storage), Intuit QuickBooks Online (invoices and payments), and SMS and email delivery providers. Invoice and payment information shown in the Services is read from MOST’s own QuickBooks Online company; payments made through QuickBooks payment pages are processed by Intuit under its own terms. MOST is not responsible for the availability or practices of third-party services, and your use of them may be subject to their terms and privacy policies.
Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.
The Services, including the software, design, text, logos, and trademarks, are owned by MOST or its licensors and are protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, MOST disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Information in the Services, such as case status, invoice balances, and document lists, is provided for convenience and may be delayed or incomplete; the records of MOST and of the relevant authorities prevail.
To the fullest extent permitted by law, MOST will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Services. MOST’s total liability for any claim relating to the Services will not exceed the amount you paid MOST for services in the twelve months before the claim arose.
You may stop using the Services at any time. We may suspend or end your access to the Services if you breach these Terms, if your engagement with MOST ends, or if needed to protect the Services or other clients. Sections that by their nature should survive termination will survive.
We may change the Services and update these Terms from time to time. When we do, we will revise the “Effective Date” at the top. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising out of these Terms or the Services will be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to their jurisdiction.
If you downloaded the application from the Apple App Store, these Terms are between you and MOST, not Apple. Apple has no obligation to provide maintenance or support for the application and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
